Terms of Service

These Terms of Service apply to mobile applications, mobile games, websites, support services, and related services published or operated by BAABAI LTD, Carlisle Business Centre Carlisle Road BRADFORD, BD8 8BD United Kingdom.

In these Terms, BAABAI LTD is referred to as "BAABAI", "we", "us", or "our". The words "app", "game", and "service" mean any BAABAI mobile application, game, website, or related service that links to these Terms.

By downloading, accessing, installing, or using any BAABAI app, game, or service, you agree to these Terms. If you do not agree, do not use the service.

These Terms are general and apply across BAABAI apps and games. Some apps or games may include additional rules, event terms, subscription terms, contest terms, community guidelines, or feature-specific notices. If additional terms apply, they form part of your agreement with us for that product.

If there is a conflict between these Terms and specific terms shown inside an app or game, the specific terms apply to that app or game to the extent of the conflict.

You must be legally able to agree to these Terms. If you are under the age of majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf.

Some services may allow or require an account, display name, profile, cloud save, or third-party platform login. You are responsible for keeping your account information accurate and secure and for all activity that occurs through your account.

We may refuse, suspend, or terminate accounts, usernames, profiles, or access where we reasonably believe there is a violation of these Terms, illegal activity, security risk, abuse, fraud, cheating, or harm to BAABAI, users, or third parties.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install, access, and use our apps, games, and services for your personal, non-commercial entertainment or utility purposes.

You do not own our apps, games, software, content, characters, artwork, audio, design, code, data, virtual items, or services. We and our licensors reserve all rights not expressly granted to you.

You agree not to misuse our apps, games, or services. This includes not attempting to hack, disrupt, overload, reverse engineer, scrape, copy, resell, modify, exploit, cheat, automate, interfere with, or gain unauthorized access to any part of a service.

You must not use our services to upload, share, or transmit unlawful, harmful, abusive, threatening, defamatory, obscene, hateful, discriminatory, sexually explicit, infringing, misleading, fraudulent, or otherwise inappropriate content.

You must not harass other users, impersonate another person, misrepresent your identity, manipulate ratings or reviews, exploit bugs, use unauthorized third-party tools, sell accounts, sell virtual items outside approved channels, or violate app store rules.

Our apps and games may be distributed through Google Play or other app stores. Your use of those stores is also governed by the applicable store terms, payment terms, refund rules, device rules, and platform policies.

If you download a BAABAI app or game through Google Play, Google may process payments, subscriptions, refunds, ratings, reviews, app delivery, security checks, and other platform services under Google's own terms and policies.

Some apps or games may offer paid downloads, subscriptions, in-app purchases, consumable items, non-consumable items, virtual currency, cosmetic items, upgrades, content packs, or other digital benefits.

Prices, taxes, billing cycles, renewal terms, cancellation rights, and refund availability are shown at the point of purchase or by the relevant app store. For Google Play purchases, billing and refunds are generally handled by Google under Google Play policies.

Virtual items and virtual currency have no cash value, are not your property, and cannot be sold, transferred, exchanged, redeemed for money, or used outside the relevant app or game unless we expressly allow it in writing.

We may manage, modify, rebalance, suspend, remove, or discontinue virtual items, gameplay features, rewards, currencies, and content where reasonably necessary for service operation, legal compliance, security, fairness, or product changes.

If a service offers a free trial or subscription, the terms shown during signup apply. Subscriptions may automatically renew unless cancelled before the renewal date through the app store account or subscription management settings.

Deleting an app usually does not cancel a subscription. You must cancel through the store or platform where you purchased it, unless another cancellation method is expressly provided.

We may update, patch, modify, suspend, restrict, or discontinue any app, game, feature, content, or service at any time. Updates may be required to continue using a service.

We may change gameplay rules, difficulty, rewards, availability, supported devices, online features, monetization, advertising, or technical requirements where reasonably necessary for operation, improvement, security, legal compliance, or business reasons.

Some services may allow you to create, upload, submit, display, or share content, such as names, messages, comments, profile details, saved creations, screenshots, images, or other materials. You are responsible for your user content.

You must have all rights needed to submit user content and must ensure it does not violate law, these Terms, or third-party rights.

By submitting user content, you grant BAABAI a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, adapt, display, publish, moderate, remove, distribute, and use that content for operating, promoting, improving, and providing the relevant service.

We may review, moderate, restrict, or remove user content where we reasonably believe it violates these Terms, applicable law, platform rules, third-party rights, or community safety.

All rights in our apps, games, websites, software, source code, object code, designs, artwork, characters, names, logos, music, sound effects, text, animations, data, gameplay systems, user interface, documentation, and related materials belong to BAABAI or our licensors.

You may not copy, distribute, sell, lease, sublicense, modify, make derivative works from, publicly display, publicly perform, reverse engineer, decompile, or otherwise exploit our intellectual property except as expressly allowed by these Terms or applicable law.

If you send us suggestions, ideas, bug reports, reviews, concepts, or other feedback, you allow us to use that feedback without restriction or compensation to you. We are not required to treat feedback as confidential.

Our services may include third-party services, SDKs, ads, links, stores, payment systems, analytics tools, social features, cloud services, or content. Third-party services are governed by their own terms and privacy policies.

We are not responsible for third-party services, content, purchases, websites, ads, products, or actions, except where applicable law says otherwise.

Our Privacy Policy explains how we may collect, use, disclose, and protect information in connection with our apps, games, websites, and services. Please read it carefully.

We may investigate suspected violations of these Terms, cheating, fraud, abuse, security threats, illegal activity, or harm to users or third parties.

Where appropriate, we may issue warnings, remove content, reset progress, restrict features, suspend access, terminate accounts, block devices or identifiers, report activity to platforms or authorities, or take other reasonable action.

Our apps, games, and services are provided on an "as is" and "as available" basis. We do not guarantee that any service will be uninterrupted, error-free, secure, compatible with every device, available in every location, or free from data loss.

To the fullest extent permitted by law, we disclaim all warranties, representations, conditions, and guarantees, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Nothing in these Terms excludes or limits rights that cannot be excluded or limited under applicable consumer law.

To the fullest extent permitted by law, BAABAI and our directors, employees, contractors, partners, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business, or opportunities.

To the fullest extent permitted by law, our total liability for claims relating to a service will not exceed the greater of the amount you paid to BAABAI for that service in the six months before the claim or GBP 50.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot legally be limited.

Where permitted by law, you agree to indemnify and hold BAABAI harmless from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the services, your user content, your violation of these Terms, or your violation of law or third-party rights.

You may stop using our services at any time. We may suspend or terminate access to any service, account, feature, or content if we reasonably believe you violated these Terms, created risk or legal exposure, misused a service, or caused harm to BAABAI, users, platforms, or third parties.

After termination, provisions that by their nature should continue will continue, including intellectual property, payment obligations, disclaimers, limitations of liability, indemnity, governing law, and dispute provisions.

These Terms are governed by the laws of England and Wales, except where mandatory consumer protection laws in your country of residence require otherwise.

The courts of England and Wales will have non-exclusive jurisdiction over disputes relating to these Terms or our services, except where applicable law gives you the right to bring a claim in another jurisdiction.

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date. If changes are material, we may provide additional notice where appropriate.

Your continued use of an app, game, or service after updated Terms become effective means you accept the updated Terms, where permitted by law. If you do not agree to updated Terms, you must stop using the service.
